Petitioner is languishing in custody since 19.01.2015 in a case registered for the offences punishable under Sections 504, 506, 307/34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the petitioner fired at Md. Munna which hit the informant.
It is submitted by the learned counsel for the petitioner that the injury has been found to be simple and superficial in nature and even assuming the accusation no case under Section 307 is made out.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds
Patna High Court Cr.Misc. No.4456 of 2015 (2) dt.04-02-2015 of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tatarpur) P.S. Case No. 860 of 2014.
Since the petitioner is accused in six other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
