Petitioner is in custody in connection with Kotwali P.S. Case No. 402 of 2019 for the offence under sections 406, 420 and 379/34 of the Indian Penal Code.
Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. He submits that there is no allegation of any overt act against this petitioner. There is no even any suggestion that he was involved in disposing of the motorcycle and the same was at the disposal of Surj Kumar for repairing the motorcycle.
Learned counsel for the petitioner submits that petitioner is in custody since 7.5.2019.
Considering the fact that petitioner has no criminal
Patna High Court CR. MISC. No.51919 of 2019(2) dt.22-08-2019 2/2 antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Patna in connection with Kotwali P.S. Case No. 402 of 2019 subject to the condition that petitioner shall deposit Rs. 25,000/- (Twenty Five Thousand) cash in the court below which shall be abide by final outcome of the pending criminal case i.e. in the event of acquittal the amount shall be refunded to the petitioner otherwise the amount shall be forfeited.
