The petitioner seeks bail in connection with Paliganj P.S. Case No. 22 of 2014, registered under section 25(1-b)A, 26 and 35 of the Indian Penal Code.
The prayer for bail was earlier rejected on 24th July, 2014 in Criminal Miscellaneous No. 25084 of 2014 with the following observation:- "The S.D.J.M., Danapur, Patna is directed to expedite the trial and conclude the same as early as possible preferably within a period of six months from the date of receipt/production of a copy of this order failing which the petitioner would be at liberty to renew his prayer for bail."
Patna High Court Cr.Misc. No.11291 of 2015 (2) dt.25-03-2015 2 / 2 It has been contended that though the petitioner is in custody since 27th January, 2014, but till date no witness has been examined on behalf of the prosecution.
Regard being had to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand)with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Danapur, Patna, in connection with Paliganj P.S. Case No. 22 of 2014.
