JUSTICE MADHURESH PRASAD ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for offence under section 3 of the RP(UP) Act.

Police at about 1.45 AM, during routine patrolling apprehended a person carrying a bag containing one DV of railway, while another person fled away. The apprehended person disclosed the name of petitioner as one who fled away. Learned counsel for the petitioner submits that merely on the confession of a co-accused he has been implicated in this case. He submits that nothing was recovered from the petitioner's possession, he has no antecedent prior to the instant case and he is in custody since 19.5.2017.

Considering the facts of the case, let the petitioner, as

Patna High Court Cr.Misc. No.39226 of 2017 (2) dt.19-08-2017 2/2 mentioned above, be released on bail on his furnishing bail bond of Rs.10, 000/- with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway Barauni (Begusarai) in RPF/Post/Garhara Police station Case No. 07/16.
