The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30, 38 and 41 of the Bihar Prohibition and Excise Act.
It is contended that as per allegation, 16 cartoons containing 335 bottles of different quantity of foreign liquor were recovered from the pick up van but not from the personal and conscious possession of the petitioner. It is further contended that petitioner's name has been implicated on the
Patna High Court Cr.Misc. No.34132 of 2017() dt.20-07-2017 2/2 basis of the confessional statement of the co-accused Gunjan Kumar whose name has been disclosed by Lalan Singh like the petitioner who has already been granted bail vide Annexure-2. Petitioner claims that he is having clean antecedent and is in custody since 28.06.2017.
Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Judge, Excise Act, Sheikhpura in connection with Korma P.S. Case No. 64 of 2016 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
