Petitioner is in jail custody since 11.12.2014 in a case registered for the offences punishable under Section 302 and other minor sections of the Indian Penal Code. Petitioner is not named in the first information report but it appears from perusal of the impugned order as well as submissions of the parties that name of the petitioner came in course of investigation.

The contention on behalf of the petitioner is that petitioner is son in law of co-accused Hukum Deo Yadav and that is the reason of false implication of the petitioner in the alleged crime.

Patna High Court Cr.Misc. No.4707 of 2015 (2) dt.04-02-2015 Learned counsel for the informant submits that in course of investigation, when the statement of injured was recorded, the injured stated about the involvement of the petitioner in the alleged crime.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that name of the petitioner came in this case near about after two months of the alleged occurrence, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S.
