Heard both sides.

Petitioner apprehends his arrest in a case under section 307 and other sections of the I.P.C.

The informant named the petitioner along with other accused persons and alleged that the petitioner assaulted her with Dab.

It is submitted that it is a counter version on account of land dispute. Case and counter case has been lodged in which the petitioner has also got injury.

It appears from perusal of the injury report that the victim got two sharp cut injuries on hers head. Of course, the case is compromised but since there is specific allegation that the petitioner assaulted the lady informant twice on head, I am not inclined to enlarge the petitioner on anticipatory bail and accordingly the same is rejected.

The petitioner is directed to surrender in the court below and the court below shall consider his prayer for regular

Patna High Court Cr.Misc. No.34857 of 2014 (2) dt.12-03-2015 bail, if filed, and dispose of the application on the same day taking into consideration that the case is compromised and the occurrence took place due to land dispute.
