Patna High Court CR. WJC No.1286 of 2021(7) dt.18-09-2025 2/3 Anchal- Phulwarisharif and District-Patna.
2. Petitioner is also seeking direction to Respondent No.8 to restrain from fraud and false deed. The petitioner is further seeking direction to Respondent No.7 to restrain from issuing false rent receipt on the basis of forged documents. He is also seeking direction to Respondent No.5 for proceeding under Sections 107, 144 and 147 of the Cr.PC against the Respondent Nos. 9,10 and 11.
3. Heard the parties on the point of admission.
4. I find that apparently, the present writ petition is not maintainable. There is alternative efficacious remedy for the relief, as sought for, by the petitioner in this writ petition. The petitioner has liberty to file appropriate civil suit for restraining the private respondents from disturbing him in his peaceful possession of the property. He can also initiate criminal proceeding against private respondents who are committing fraud. For initiation of proceeding under Sections 107, 144 and 147 of Cr.PC, the petitioner has already remedy to initiate proceeding before the local area Executive Magistrate.
5. Hence, the present writ petition is dismissed as non-maintainable, on account of availability of efficacious alternative remedy to the petitioner.
