The petitioners are apprehending arrest in a case registered for the offences punishable under sections 447,341,323,326A,307,435 and 504/34 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is that in the background of dispute with regard to construction of village road, co accused Surendra Thakur assaulted the informant and abused him by calling the caste name. It is further alleged that on the order of co accused Surendra Thakur the accused persons threw acid on the informant and others.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.12796 of 2016 (2) dt.28-03-2016 2/2 petitioners that the injuries have been found to be simple in nature and there is counter version of the occurrence. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Narpatganj P.S. Case No. 22 of 2016 pending in the court of learned CJM, Araria. This application is disposed of with the aforesaid observation/direction.
