JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2017 The petitioner seeks regular bail in connection with Aurangabad (M) P.S. Case No. 59 of 2017, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is of recovery of 800 litres of country made liquor.
It has been submitted on behalf of the petitioner that nothing has been recovered from the conscious possession of the petitioner rather the recovery has been made from the vehicle, in which petitioner was only a passenger. Further he has no criminal antecedent and has been in judicial custody 27.04.2017. Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.40054 of 2017 (2) dt.23-08-2017 circumstances of the case, I am not inclined to release the petitioner on bail at this stage, rather this application is disposed of with direction to court below to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, the trial court shall release the petitioner on bail to his own satisfaction.
