JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 18.02.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is husband of the informant and there is allegation against him that he used to torture the informant by different ways and on one occasion, he assaulted the informant causing four injuries on her person.

Learned counsel for the petitioner submits that the petitioner is ready to keep the informant with full honour and dignity. Taking note of the aforesaid submissions as well as facts and circumstances of the case, prayer for anticipatory bail of the petitioner in connection with Sonbarsa P.S. Case no. 14/2014 pending in the court of the Chief Judicial Magistrate, Sitamarhi/concerned court stands rejected.

However, if the petitioner surrenders before the court below along with the informant within six weeks from today and informs the

No.34493 of 2014 (2) dt.18-02-2015 concerned court that he as well as informant have amicably settled their dispute, the concerned court shall consider regular bail application of the petitioner on its own merit without being prejudiced by this rejection order, particularly, keeping in mind the factum of compromise.
