The petitioners seek pre-arrest bail in connection with Begusarai Town (Ratanpur) P.S. Case No.719 of 2015 registered under Sections 448, 379/34, 506, 504 and 354/34 of the Indian Penal Code.
It is contended that no occurrence as alleged has taken place in the present case and, as a matter of fact, one Premnath Gupta had executed agreement to sell on 29.3.2011 in favour of petitioner no.1 Chitradeo Poddar for Tauzi No.3518, Thana No.348, Khata No.64, Khesra No.1497 admeasuring an area of
Patna High Court Cr.Misc. No.13921 of 2016 (2) dt.01-04-2016 2/2 four Dhurs on which a Pucca building of eight feet wide and thirty feet long was constructed for a total consideration of Rs.3,11,000/- and out of total consideration amount, Rs.3,11,000/- was received by the informant Premnath Gupta at the time of execution of agreement to sell and the remaining amount was to be paid at the time of execution of registered deed. Regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within four weeks from today, the petitioners, namely, Chitradeo Poddar, Sapan Poddar, Uttam Kumar @ Uttam Poddar. Mannu Kumar @ Mannu Poddar and Bimal Kumar @ Bimal Poddar are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town (Ratanpur) P.S.Case No. 719 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
