JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 Petitioner seeks bail in anticipation of her arrest in connection with Bakhtiarpur P.S. Case No. 644 of 2018 registered for the offences punishable under Sections 341, 323, 307, 354/34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that accused persons, including the petitioner entered inside the house of the informant and allegation against petitioner is that he thrashed her on the ground, due to which she received injury on her face and there is also allegation of outraging her modesty.

Submission of learned counsel for the petitioner is that informant is his own Bhabhi and dispute arose with respect to passing of drainage water and due to that he has falsely been implicated in this case.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, District Patna, in connection with Bakhtiarpur P.S. Case No. 644 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
