The petitioner apprehends his arrest in K. Hat P.S. Case No. 276 of 2010 registered for the offence punishable under Section 394 of the Indian Penal Code.

It is submitted that the petitioner is not named in the FIR. Even name of the petitioner did not figure in the confessional statement of co-accused. Name of the petitioner figured in the case on mere suspicion in the supervision note of Dy. S.P. Save and except suspicion, there is no material against the petitioner and the police after five years of the occurrence submitted charge sheet against the petitioner that too on mere suspicion. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court

Patna High Court Cr.Misc. No.14187 of 2016 (4) dt.19-05-2016 2/2 below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnia in K. Hat P.S. Case No. 276 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
