Let the defect (s), as pointed out by the office, be removed within a period of four weeks from the date of resumption of physical filing and physical removal of defect. In the present case, the petitioner seeks bail in connection with Barauni P.S. Case No. 478 of 2020 registered for the alleged offences under Section 366 (A) of the Indian Penal Code.

The prosecution case is that the informant named the petitioner as a person who enticed away his daughter for the purposes of marriage.

Learned counsel for the petitioner submits that the

No.65263 of 2021(5) dt.28-06-2022 2/2 daughter of the informant is major and she willfully went away with the petitioner and both of them have solemnized marriage, so no case is made out under Section 366 (A) of the Indian Penal Code. The victim girl has admitted the aforesaid fact in her statement recorded under Section 164 Cr.P.C. Considering all these facts, this petitioner was enlarged on provisional bail vide order dated 16.05.2022 passed by a co-ordinate Bench of this Court.

Learned counsel for the informant has supported the contention of the petitioner.

Having regard to the aforesaid facts and circumstances and submissions made hereinabove, the provisional bail granted to the petitioner vide order dated 16.05.2022 is hereby confirmed.
