2. Petitioner seeks regular bail in connection with Sultanganj P.S. Case No. 281 of 2023 (G.R. No. 2904 of 2023) dated 31.05.2023 registered for the offence punishable under Section 395 of the Indian Penal Code.

3. The main submissions advanced by the petitioner's counsel are that the petitioner has been made accused mainly on account of the alleged recovery of the looted mobile phone from his possession but in fact, the petitioner purchased the said mobile phone from his brother-in-law, Chotu Kumar, coaccused, who has been granted bail by the trial court itself and except the recovery of the said mobile phone, there is nothing

Patna High Court CR. MISC. No.54680 of 2025(5) dt.17-12-2025 2/2 against this petitioner to show his involvement in the alleged loot. It is further submitted that the petitioner bears no criminal antecedent and has been languishing in jail since 28.03.2025.

4. Learned APP for the State has opposed the prayer for bail of the petitioner.

5. Considering the aforesaid submissions and mainly petitioner's fair and clean antecedent coupled with his custody period, this Court is inclined to release him on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Sultanganj P.S. Case No. 281 of 2023 (G.R. No. 2904 of 2023).
