The petitioner seeks regular bail in a case registered under Sections 379, 384 and others sections of the Indian Penal Code and Section 3(i)(x) of the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act.

The informant alleged that the petitioner along with other accused persons having armed with different weapons came and they all assaulted the informant. The also abused the informant by naming her caste. Rudal Mukhiya snatched a chain from the informant.

It is submitted that the petitioner is the next door neighbour of the informant. She wanted to grab the land of the petitioner and that is why this false and concocted case has been lodged. Rudal Mukhiya has already been enlarged on bail vide

Patna High Court Cr.Misc. No.5793 of 2015 (2) dt.11-02-2015 2/2 order passed in Cr. Misc. No. 1813 of 2015. Case of the petitioner stands on similar footing as that of co-accused Rudal Mukhiya. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Rosera, Samastipur in Hasanpur P.S.
