Prayer is allowed.
This petition for anticipatory bail, so far as it relates to petitioners No.1 and 2, is, accordingly, dismissed as withdrawn. Heard both sides.
The petitioner No.3, Amrendra Yadav, apprehends his arrest in Madhepura (Parmanandpur O.P.) P.S. case No. 654 of 2015 under Section 384, 386, 379, 447, 504, 34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.17166 of 2016 (3) dt.30-08-2016 2/3 The informant, Tarni Prasad Yadav, made allegation that he purchased a piece of land but the petitioner, Amrendra Yadav, Ravindra Yadav and Manohar Yadav demanded extortion and did not allow the informant to cultivate the land. Manohar Yadav forcibly took his signature on a plain paper and the petitioner and his brother, Ravindra Yadav, are alleged to have snatched money from the possession of the informant. It is submitted that entire allegation is false. The petitioner purchased the land from Hriday Yadav in the year 2010. The informant, Tarni Prasad Yadav, is own brother of the father of petitioner. There is land dispute between the parties.
Hriday Yadav, father of Tarni Prasad Yadav, the informant, is grand father of the petitioner who sold the land in favour of petitioner and his brother and that is why this false case has been lodged. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner No.3, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.
