JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-07-2017 The petitioner seeks regular bail in connection with Goraul (Kathara O.P.) P.S. Case No. 39 of 2017, registered for offences punishable under Sections 341, 323, 504, 506, 307, 379, 448, 435,427 and 34 of the Indian Penal Code. Allegation against the petitioner is of firing on the informant causing injury on this thigh.
It has been submitted on behalf of the petitioner that there is case and counter case between the parties and though there is allegation of firing, however, it is not ascertained whether injury is simple or grievous in nature. Further petitioner has been in judicial custody since 01.03.2017.
Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for bail and submitted
Patna High Court Cr.Misc. No.34564 of 2017 (2) dt.28-07-2017 that the informant is still under treatment and the bullet is still in his thigh.
Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the petitioner may renew his prayer for bail after framing of charge in this case.
