1. Heard Mr. Ashok Kumar Jha, learned counsel for the petitioners and Mr. Ram Sumiran Rai, learned APP for the State.

2. The petitioners seek regular bail in connection with Tariyani P. S. Case No. 130 of 2025 dated 13.06.2025, registered for the offences punishable under Sections 329(3), 126(2), 115(2), 103(1) and 3(5) of the B.N.S.

3. The main submissions advanced by the petitioners counsel are that both the petitioners are ladies, of whom petitioner no. 2 is unmarried, both have been languishing in jail since 14.06.2025, the FIR clearly shows that the main allegation as to inflicting sword blow is against the co-accused Priyanshu Kumar and the deceased's postmortem report, discussed in the trial court's order shows that the deceased sustained a puncture wound to his chest which resulted in his death and the said injury is specifically

No.54199 of 2025(2) dt.18-08-2025 2/2 attributed to the co-accused Priyanshi Kumar, though, against the petitioner no.2, there is allegation of having inflicted lathi blow on the head of the deceased but there is no injury on the head of the deceased as per the trial court's order. It is lastly submitted that on the alleged day of occurrence there was a dispute with regard to flow of water in drain in between the parties, which resulted in exchange of abuses and finally the commission of the alleged occurrence, showing that the alleged occurrence was not preplanned.

4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.

Considering the aforesaid submission advanced by petitioners' counsel and mainly the nature of allegation appearing against petitioners and also their custody period, this court is inclined to release them on bail. Accordingly, let the petitioners named-above be enlarged on bail in connection with Tariyani P.S. Case No. 130 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned.
