From perusal of the impugned order of the learned Sessions Judge, it appears that it was co-accused Deepak Kumar who opened fire causing death of the deceased and so far as the petitioner is concerned, it is only stated that he along with other accused participated in throwing dead body of the deceased in a drainage. More over, co-accused Parikshhit Gupta @ Parikshit Gupta and Chintu @ Kunj Bihari Sharma have already been granted privilege of bail.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur in Samastipur (Town) P.S. Case no. 229/2014. shahid (Hemant Kumar Srivastava,J) U T
