JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-10-2021 Heard learned counsel for the petitioner as well as learned counsel for the opposite party no. 2. Allegedly the marriage of the petitioner was solemnized with the opposite party no. 2 on 10.07.2016. It is further alleged that at the time of marriage, it was said that the petitioner was working in Railway whereas he was a Teacher in private school. Further allegation is of demanding Rs.2,00,000/- and torturing the complainant for non-fulfillment of demand of dowry.
It appears that this Court has granted provisional bail to the petitioner, vide order dated 19.08.2019, and referred the matter in the Mediation Centre, Patna High Court.
Patna High Court CR. MISC. No.51052 of 2019(6) dt.27-10-2021 2/2 The report of Mediator dated 18.11.2019 is available on record which shows that despite several opportunities, none of the parties appeared before the Mediator.
In the above facts and circumstances, the provisional bail granted to the petitioner is hereby confirmed with the direction that both the parties shall appear before the court below and the court below shall take recourse of District Mediation Centre. If the court below finds that due to apathy of either of the parties the process of mediation is hampering, the court below will be at liberty to pass any appropriate order including the cancellation of the bail bond.
