JUSTICE AMARESH KUMAR LAL ORAL ORDER 10-02-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is in custody since 17.11.2014 for the offence punishable under Sections 147, 148, 149, 323, 325, 307, 447, 448, 452, 353, 186, 188, 332, 333, 337, 338, 427, 435, 436, 109, 224, 225, 440, 120B of the Indian Penal Code and Section 52 of Prisoners' Act.
It is alleged that when the I.G., Prisons ordered for shifting of two prisoners Santosh Jha and Madhav Jha from Sitamarhi Jail to Central Jail, Gaya and Buxar, the jail inmates protested and assaulted the jail authorities. It is submitted that 107 prisoners were named in the FIR including the petitioner and 100-150 were unnamed prisoners. In similar facts and circumstances, the co-accused Rajan Chaudhary
Patna High Court Cr.Misc. No.5447 of 2015 (2) dt.10-02-2015 2/2 has been granted bail vide Cr. Misc. No.2605/2015. The learned counsel for the State submits that the petitioner has also criminal antecedents.
Considering the facts and circumstances of the case, let the above-named petitioner be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi/court concerned in Dumra P.S. Case No.285/2014 after framing of charge with the following conditions : 1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4.
In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
