JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code, section 47(a) of Excise Act and Rules 3 and 5 of Bihar Excise (Mahua Flowers) Rules, 2006. The prosecution case is that 24 bags of Mahua flower each containing 40 kilograms was recovered from the house of Lalita Devi when she suggested that the petitioners stored the bags giving an impression to her that the bags contain maize. It is submitted by the learned counsel for the petitioners that admittedly the recovery has been made from the house of Lalita Devi and Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
