The petitioner is accused in connection with Pipra Kothi P.S. Case No. 37 of 2013 registered under Sections 395, 397 and 412 of the Indian Penal Code.

Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier rejected on merit vide order dated 27.01.2014 passed in Cr. Misc. No. 29940 of 2013 by this Court with observation that if the trial of the petitioner is not concluded within one year, the petitioner would be at liberty to renew his prayer for bail and he is in custody since 19.02.2013. It is further submitted that charges has not been framed as yet and

Patna High Court Cr.Misc. No.5597 of 2015 (2) dt.08-04-2015 trial has also not proceeded.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari in connection with Pipra Kothi P.S. Case No. 37 of 2013. Out of two sureties one surety must be the parent or close relative of the petitioner.
