The petitioner is apprehending his arrest in connection with Ariyari P.S.Case 137 of 2016 registered for offences punishable under Sections 406, 408, 409, 419, 420, 467, 468, 471/34 of the Indian Penal Code.
Allegation against the petitioner is that he is Panchayat Secretary and he has not deposited the papers before the authorities concerned in pursuance of direction of the higher authorities.
Submission of the learned counsel for the petitioner is that he has supplied the papers of that period during which he was Panchayat Secretary.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.46019 of 2018 (2) dt.09-08-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of receipt of the order and on surrender he will be released on provisional bail in connection with Ariyari P.S.Case No.137 of 2016 till submission of the charge-sheet. In the meantime, he will supply all the papers to the Investigating Officer and if the charge-sheet is submitted and the case is found true against the petitioner, he will surrender and make prayer for regular bail, which will be considered by the learned court below on its own merit on the basis of materials available on the record.
