JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-02-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sessions Trial No. 712 of 2013, arising out of Shastri Nagar P.S. Case No. 351 of 2012 registered under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier rejected on merit vide order dated 16.07.2014 passed in Cr. Misc. No. 21240 of 2014 by this Court with direction to expedite the trial of the petitioner and conclude the same, preferably, within a period of six months. If the trial of the petitioner is not concluded within the aforesaid

Patna High Court Cr.Misc. No.5335 of 2015 (2) dt.18-02-2015 period, the petitioner would be at liberty to renew his prayer for bail. It is further submitted that seven witnesses including the family members of the deceased have been examined but they have not supported the prosecution case and the case is pending for evidence of the remaining witness and petitioner is in custody since 07.01.2013.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IX, Patna, in connection with Sessions Trial No. 712 of 2013, arising out of Shastri Nagar P.S. Case No. 351 of 2012.
