The petitioner seeks bail in anticipation of his arrest in connection with Bhargama P.S. Case No. 144 of 2015 dated 08.07.2015 instituted for the offences under Sections 341, 323, 354, 353 and 504 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that during the course of investigation, the petitioner was issued notice under Section 41 (1) of the Code of Criminal Procedure by the Police and was released thereafter. The occasion for filing anticipatory bail petition before the court below arose when chargesheet under the same Sections was submitted. The petitioner is thereafter directed to

Patna High Court Cr.Misc. No.42169 of 2018(2) dt.20-07-2018 2/2 surrender before the court below and seek bail. The court below shall take into account that there is a dispute with regard to mid-day meal in the school; the petitioner is an outsider and is only husband of the Secretary of the School Education Committee and that he has participated in the investigation, and after notice to him to appear before the police, he was released, and shall pass orders in accordance with law, preferably on the same day.

This petition is disposed off with aforesaid liberty.
