JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 25-06-2018 On 14.12.2011 liberty was granted to the petitioner to file I.A. to press his prayer for interim orders. Thereafter the case was listed on 24.8.2017 but no one had appeared on behalf of the petitioner. Again the case was listed on 3.11.2017 and on that day prayer was made for further adjournment. The case was again listed on 22.6.2018 but no one had appeared on behalf of the petitioner. Even today when the case is called no one has appeared. This writ petition has been filed by the petitioner for quashing the notification dated 17.11.2011 whereby the respondent No. 5 was authorized to discharge the function of the Principal.
Patna High Court CWJC No.22070 of 2011 dt.25-06-2018 2/2 Considering the time gap and the nature of dispute, the Court has reason to believe that the petitioner has lost interest and that is why no one is appearing on behalf of the petitioner in the present proceeding. On 22.6.2018 opportunity was granted to the petitioner and the case has been listed today. Even today when the case is called out no one has appeared.
In the aforesaid circumstances, the writ petition is dismissed.
However, liberty shall be available to the petitioner to approach the appropriate forum/Court in accordance with law notwithstanding the dismissal of the present writ petition, if any grievance is subsisting.
