Heard both sides.

Petitioner seeks bail in a case under Sections 302 and other sections of the I.P.C. and section 27 of the Arms Act. The informant named 10 persons including the petitioner and alleged that on the order of Sudama Kumar, his son Sonu Kumar made indiscriminate firing which hit on the head of the son of the informant, who died on the spot.

It appears that the petitioner was only member of the mob and there is no allegation of firing against him. The petitioner is in custody since 8.11.2014.

Considering the facts aforesaid and that the petitioner is in custody since 8.11.2014, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Bhagalpur in connection with Akbar Nagar P.S.Case No. 73 of 2014.
