JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 28-04-2016 Heard the counsel for the petitioners and Mr. Ambika Bhagat for the State.

The two petitioners seeks anticipatory bail in Jagdishpur (Goradih) P.S. Case No. 158 of 2015 registered under sections 307, 504 IPC, section 3(i) (x) of SC/ST Act and section 27 of the Arms Act.

It is submitted that the allegation of assaulting the two injured is not attributed to the petitioners. There is a counter version also of the occurrence in the shape of an FIR lodged by the co-accused Kishore Mandal. The petitioners do not carry any criminal antecedents. It is further submitted that considering the above seven other co-accuseds of this case have been granted anticipatory bail vide order dated 14.03.2016 passed in Cr. Misc.

Patna High Court Cr.Misc. No.17036 of 2016 (2) dt.28-04-2016 2/2 No. 6631 of 2016.

In the circumstances, let the petitioners named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of CJM, Bhagalpur in Jagdishpur (Goradih) P.S. Case No. 158 of 2015 on conditions that one of the bailors shall be their own/close family members. They shall appear on each date fixed at the trial. None appearance shall entail cancellation of their bail bonds. (Kishore Kumar Mandal, J) HR/- U T
