This application is for grant of regular bail in connection with Muzaffarpur Town P.S.Case No.199 of 2017for the offences punishable under Sections 457 and 380 of the Indian Penal Code and later on Seciton411 IPC has been added. Petitioner is not named in the FIR. Allegation of committing theft inside the bank of ATM cards and other articles. Submission of the learned counsel for the petitioner is he is not named in the FIR and later on his name transpired and there is recovery of 3 ATM Cards. Apart from the other articles some cash has also been recovered but there is no allegation of theft of cash from the bank in this case. It has further been submitted that the petitioner is accused in three other cases and now he is in custody for seven months.

Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, since the petitioner is in custody for seven months, the learned trial court is directed to expedite the trial and try to conduct it on day to day basis so that it may be concluded within a period of five months and if not concluded, the learned trial court shall release the petitioner on bail to his own satisfaction.
With the aforesaid observation, this application is disposed of.
