JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner, State and counsel appearing on behalf of the informant. The petitioner is an accused in Sheikhpura (Sirari O.P.) P.S. Case No. 250 of 2015 for the offence under sections 323/307 of the Indian Penal Code and Section 27 of the Arms Act. From perusal of Annexure-2, it appears that police after investigation submitted final form, saying that accusation was untrue.
Counsel for the informant submits that after submission of the final form, the Magistrate differed and took cognizance. Be that as it may, the fact remains that the police after investigation has submitted final form, saying that the accusation was untrue.
In view of the aforesaid facts as borne out from
Patna High Court Cr.Misc. No.27445 of 2017 (2) dt.07-07-2017 2/2 Annexure-2, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura (Sirari O.P.) P.S. Case No. 250 of 2015 on the condition that the petitioner will extend full cooperation in the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
