This application is for grant of regular bail in connection with Bihpur Rail P.S.Case No.02 of 2016, registered for the offences punishable under Sections 328, 379 & 307 of the Indian Penal Code.

Allegation against the petitioner is of administering intoxicant articles to the co-passenger and due to which he became unconscious and thereafter he looted his articles. Submission of the learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and he is accused in two other cases also. Heard learned A.P.P. also.

Having heard both sides and from perusal of the

Patna High Court Cr.Misc. No.27942 of 2017 (4) dt.08-08-2017 2/2 report as called for from the court concerned, it appears that in this case several witnesses have already been examined and the learned counsel for the peititoner has submitted that all the witnesses have been examined in this case.

In such view of the matter, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of three months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court concerned, who will consider the materials present on the record and will pass appropriate order. With the aforesaid observation, this application is dismissed.
