The petitioner seeks regular bail in connection with Delha P.S. Case No. 176 of 2019, registered for the offence punishable under Sections 341, 323, 324, 308, 504, 506 and 379/34 of the Indian Penal Code.

The allegation is regarding the F.I.R. named accused persons having had a quarrel with one Vishal whereafter it is alleged that the co-accused person, namely, Atul had attacked the informant with knife and broken his mobile and also took away the gold locket which had fallen on the ground during the scuffle.

The learned counsel for the petitioner submits that the petitioner has got no role to play in the alleged incident

No.51923 of 2019(3) dt.27-09-2019 2/2 and in fact, a bare perusal of the FIR would show that there is no allegation of any sort of overt act as the petitioner is concerned and he has merely been stated to be standing along with the aforesaid Vishal. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 30.6.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate VII, Gaya in connection with Delha P.S. Case No. 176 of 2019.
