Even today no one is present for the petitioner to press this petition. The counsel for the State is present.

The Court has no other alternative but to dispose of this petition which relates to the appointment of Anganwari Sevika. From the letter no. 457 dated 4th March 2013 issued by the Office of the Sub-Divisional Officer, Gopalganj it appears that on enquiry, a report was submitted by the Sub-Divisional Officer where he has informed that the entire proceeding is suffering from illegality and so much so that Aam Sabha could not be completed on account of

Patna High Court CWJC No.14107 of 2013 dt.01-12-2016 2/2 the fact that some disturbance was created by the villager inasmuch as coram was also not completed and was suggested that the step should be taken for fresh selection.

The counsel for the State submits that the aforesaid letter indicates that the entire process of selection was tainted, cannot be legalised.

It appears that the fresh process of selection was started and must have been completed by the I.C.D.S. and the petitioner is no longer interested to pursue this petition, in such view of the matter, this petition is dismissed.
