JUSTICE AMARESH KUMAR LAL ORAL ORDER 27-02-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under sections 121, 121 (B), 120 (B)/ 414 of Indian Penal Code and 10, 11, 17, 18, 118 (A), 19/20 of Unlawful Activities Prevention Act, 17 of C.L.A. Act and under section 25 (1-B)A, 26/35 of the Arms Act.

It is submitted that the allegation against the petitioner is that during a raid, one country made pistol with live cartridge and one mobile were recovered from the possession of the petitioner. It is further submitted that the petitioner was going to home and in the way, the police arrested him without assigning any reason and took his signature on some blank papers. The petitioner has no criminal antecedent.

Considering the facts and circumstances, the above named petitioner, Nand Lal Kumar Bhagat is directed to be

Patna High Court Cr.Misc. No.6712 of 2015 (2) dt.27-02-2015 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge- Cum- Special judge, Muzaffarpur in connection with Kathaiya P. S. Case No. 92/2014 with following conditions :- I) One of the bailors will be the close relative of the petitioner.

II) The petitioner will not indulge in similar or in any other offence.

III) The petitioner will be well represented in the Court.

IV) In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the Court concerned.
