Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Madhepura (Parmanandpur O.P.) P.S. Case No. 719 of 2022, lodged under Section 21(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 read with Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution case, the total recovery 315 bottles which containing 100 ml of cough syrup containing NDPS Codine material is there.
Learned counsel for the petitioner submits that petitioner is innocent lady and having clean antecedent and she
Patna High Court CR. MISC. No.55366 of 2022(2) dt.02-12-2022 2/2 is in custody since 30.07.2022 and charge-sheet has already been filed in this case. Learned counsel also submits that it comes in the F.I.R. that the codine material is 31.500 ml is there and if it shall be converted into solid then it shall be less than 10 gm.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, N.D.P.S. Act, Madhepura in connection with Madhepura (Parmanandpur O.P.) P.S. Case No. 719 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
