Petitioner has been apprehended on the basis of statement made by co-accused Pankaj Kumar Srivastava at the time of investigation and under identical situation, co-accused Pankaj Kumar Srivastava @ Jhunnu in Cr. Misc. No.5381 of 2009, Sankar Sah in Cr. Misc. 5489 of 2009, Sudhir Kumar Bishwash in Cr. Misc. No.45556 of 2009 and Ajay Kumar Singh @ Ajay Kumar Sinha @ Chhotu in Cr. Misc. No.46771 of 2008 have been granted bail by co-ordinate Benches of this Court. Keeping in view the aforesaid, this application is allowed.
