2. The petitioner seeks regular bail in connection with Piar P.S. Case No. 52 of 2024 registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was also added.
3. As per the prosecution case, the husband of the informant, namely, Harendra Sahni was taking tea at the stall of
Patna High Court CR. MISC. No.61104 of 2024(2) dt.30-08-2024 2/3 Shibu at Pethiya Chowk and in the meantime all the accused persons including the petitioner started abusing the husband of the informant and when her husband forbid them to abuse him then the petitioner along with co-accused Rakesh Sahni and Sunny Kumar inflicted danda on the head of her husband causing injury on his head due to which he became unconscious.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case because of his relationship with other accused persons. He further submits that there is general and omnibus allegation against the petitioner. He also submits that the charge-sheet has already been submitted and cognizance has already been taken in this case by the Court Concerned against the petitioner. The petitioner is in jail custody since 28.02.2024. He further submits that the petitioner has no criminal antecedent and he undertakes to co-operate in the investigation and the trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties
