1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Muzaffarpur Rail Police Station Case No. 75 of 2025, dated 29.03.2025, disclosing offences punishable under Section 304 of the Bhartiya Nyaya Sanhita, 2023.

3. The First Information Report has been registered against two unknown criminals. The prosecution case, as per the First Information Report, is that while the informant was going from Jhanjharpur to Hajipur in Danapur Intercity Express and when he came out of lavatory of the train, an unknown miscreant snatched his mobile and fled away.

4. Learned Counsel for the petitioner submits that the

He further submits that the petitioner has got no criminal antecedent and he is not named in the First Information Report. He next submits that during the investigation, the mobile phone of the informant was recovered from the possession of coaccused Tribhuwan Kumar and the name of the petitioner transpired in the confessional statement of co-accused persons, who, not only confessed their guilt, but have also disclosed the name of the petitioner as one of the member of the gang, who used to snatch the mobile phone and after opening the digital lock of the phone, sell it.

5. I have heard learned Counsel for the parties concerned and have perused the material available on record, including the impugned order.

6. From perusal of the impugned order, it transpires that the co-accused persons, in their confessional statements, have disclosed the active involvement of the petitioner in the alleged offence.

7. Considering the above, I do not find any reason to differ with the findings arrived at by the learned Additional Sessions Judge-XVII, Saran, at Chapra, inasmuch as the

No.55327 of 2025(2) dt.27-08-2025 3/3 case is under investigation, wherein the custodial interrogation of the petitioner may be necessary based upon the material collected by the police during course of investigation. As such, I am not inclined to grant anticipatory bail to the petitioner.
