====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 15-09-2017 Heard Sri Dilip Kumar Roy, learned counsel for the petitioner and Sri Sunil Kumar Pandey, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 31.05.2017 in Warisnagar (Mathurapur O.P.) P.S.Case No.37 of 2017 registered for the offence under Section 273 of the Indian Penal Code and Sections 30(a)/37(a)/37(d)/38/41of the Bihar Prohibition and Excise Act,2016, has prayed for grant of bail. Learned counsel for the petitioner, by way of referring to the statement made in paragraph-3 of the petition, submits that the petitioner is having clean antecedent. He submits that on accusation of recovery of huge quantity of Indian Make Foreign liquor from the flour mill of the petitioner, he was made accused

Patna High Court Cr.Misc. No.36608 of 2017(5) dt.15-09-2017 2/2 and immediately after noticing the fact that the petitioner was made accused, he surrendered on 31.05.2017 and since then he is in custody.

Considering the nature of accusation, period of custody as well as clean antecedent, let the petitioner, namely, Rahul Singh @ Aditya Kumar Singh be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Samastipur in connection with Warisnagar (Mathurapur O.P.) P.S. Case No.37 of 2017.
