The petitioner is languishing in custody for the offence punishable under Section 498A/34 of the Indian Penal Code.

Petitioner is husband of Opposite Party No.2. Allegation is of demand of dowry and torture for the same. Submission is that petitioner is ready to keep the informant with full honour and dignity.

Considering the aforesaid fact, let the petitioner, above named, be released on provisional bail on furnishing bail

Patna High Court CR. MISC. No.52847 of 2019(2) dt.29-08-2019 2/2 bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khagaria (Mahila) P.S. Case No.38 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) Petitioner shall ensure restoration of conjugal life within two months from the date of release and shall report before the learned Court-below. If the Court-below would come to the notice that wife is not cooperative in restoration of matrimonial life, the provisional bail of the petitioner shall be confirmed.

(c) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
