The petitioner apprehends his arrest in connection with S.G.R. No. 50 of 2018, arising out of Majhaulia P.S. Case No. 155 of 2018, registered under Section 366(A)/34 of the Indian Penal Code and Section 8 of the Protection of Children From Sexual Offences Act.

The accusation is that daughter of the informant aged about 16 years was alone at the house in the night of 25.04.2018, as the informant and his other family members had gone to attend marriage ceremony in his relation. The daughter of informant left the house with cash of Rs.5000/- and ornament worth of Rs. One lakh. In course of search, the informant came to know that his daughter has been kidnapped

Patna High Court CR. MISC. No.51081 of 2019(2) dt.17-08-2019 2/2 by Durgesh Yadav with the help of petitioner for the purpose of marriage.

Learned counsel for the petitioner submits that, in fact, due to love affairs the daughter of the informant and Durgesh Yadav left the village, but with ulterior motive, the informant implicated the petitioner being the father of coaccused Durgesh Yadav. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-Icum-Special Judge, Bettiah, West Champaran in connection with SGR No. 50 of 2018, arising out of Majhaulia P.S. Case No. 155 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
