The petitioner seeks bail in connection with Kumarkhand (Bhatni O.P.) P.S. Case no. 151 of 2015 registered under Sections 392 of the Indian Penal Code.

Three unknown miscreants are said to have looted away motorcycle, cash of Rs. 1250/-, blanket etc. of the informant on the point of pistol who happens to be hawker. It is submitted by the learned counsel for the petitioner that the petitioner is not named in the F.I.R. No incriminating article has been recovered from his conscious physical possession. His name has surfaced in the case only on the basis of confessional statement of the co-accused Brajesh Kumar and the said coaccused has been enlarged on bail by a co-ordinate Bench of this

Patna High Court Cr.Misc. No.38199 of 2017 (2) dt.11-08-2017 2/2 Court vide order dated 20.08.2016 passed in Cr. Misc. no. 32709 of 2016. Though two other cases have also been lodged against the petitioner, but he is on the bail in the aforesaid two cases. The petitioner has been languishing in custody since 07.04.2017. Considering the facts and circumstances of the case, let above named petitioner, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhepura in connection with Kumarkhand (Bhatni O.P.) P.S. Case no. 151 of 2015.
