The petitioner seeks bail in Sadar P.S. Case No. 366 of 2014, registered for the offences punishable under Sections 4/6 of the POCSO Act.

The victim made allegation that while she along with her cousin were going to attend the call of nature, the petitioner and others caught her Dupatta and tried to outrage her modesty. Learned counsel for the petitioner submits that the petitioner is the neighbour of the informant. No occurrence as alleged has ever taken place. The informant did not receive any injury. The petitioner is in jail since 04.10.2014. Five persons are alleged to have tried to outrage the modesty of the informant and others.

Considering the facts aforesaid and the nature of

Patna High Court Cr.Misc. No.9990 of 2015 (2) dt.13-03-2015 2/2 allegations made against the petitioner and the fact that the petitioner is in jail for more than five months, he above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judgecum-Special Judge, Darbhanga in connection with Sadar P.S. Case No. 366 of 2014.
