JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 The petitioner seeks regular bail in connection with Simultala P.S. Case No. 22 of 2017, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 265 pouch of country made wine.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the basis of suspicion and nothing has been recovered from his possession and he has been in judicial custody since 09.07.2017. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and as the petitioner has criminal

No.37842 of 2017 (4) dt.24-08-2017 antecedents as he is accused in two other cases out of which one is of similar nature, as such, this application is disposed of with direction to the court below to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, he will release the petitioner on bail to his own satisfaction.
