JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 15-11-2016 The petitioner is challenging the order dated 20th June 2011 passed by the District Magistrate, Patna whereby rejected the claim of the petitioner, he was appointed as Kutchery Sachiv of village Karja. In the order, it has been held that though the petitioner applied for the post of Gram Kutchery Sachiv and has claim that he was validly appointed after appearing in the counselling, but has illegally been deprived of salary with effect from 5.12.2007. The petitioner moved before this Court in C.W.J.C. No. 6926 of 2010 which was disposed of on 13.01.2011 with a direction to dispose of the representation of the petitioner whereupon the District Magistrate

Patna High Court CWJC No.14474 of 2013 dt.15-11-2016 2/2 called for the records and found that the present petitioner has wrongly been appointed along with Harishankar Bidhayarthi, without facing the proceeding of the counselling, in connivance with the Sarpanch.

This Court does not find any merit in the present petition and the same is, accordingly, dismissed on the ground that petitioner's appointment was itself illegal.
