ANJANA MISHRA ORAL ORDER 20-10-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 420/409/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that earlier a report had been called for, from the Block Development Officer, Haspura Block, Aurangabad with regard to completion of work of the construction of school building of Primary School, Chahunta under Haspura Block in the district of Aurangabad. A report dated 14.09.2016 has been submitted to this Court vide letter No. 1254 from the office of Block Development Officer, Haspura Block, Aurangabad. The said report indicated

Patna High Court Cr.Misc. No.17285 of 2016 (9) dt.20-10-2016 P2/2 that the work in question has now been completed and the money which had been drawn towards construction of the kitchen which could not be done for want of adequate land, has now been returned with interest vide cheque No. 599366 dated 06.09.2016. Thus, the report indicates that a substantial portion of the work has already been done and whatever extra money was drawn by the In-charge Headmaster, has now been returned.

In view of such facts and circumstances, let the petitioner Shailesh Kumar abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Haspura P.S. Case No. 32/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
