====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 23-08-2017 Heard Sri Md. Shakil Ahmad Khan , learned counsel for the petitioner and learned A.P.P.

This is second attempt for grant of bail on behalf of the petitioner. Earlier , prayer for bail of the petitioner was rejected on 01.12.2016 vide Cr. Misc. No. 40445 of 2016. It was submitted by learned counsel for the petitioner that petitioner was made accused in the present case on confession of co- accused namely Laxman Patel , who was non else but uncle of the petitioner and there was strained relation in between them. By way of referring to annexure - 3 to the petition learned counsel for the petitioner submits that co -accused Laxman Patel has already been extended the privilege of bail by order dated 23.05.2017, passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.31978 of 2017(2) dt.23-08-2017 2/2 18416 of 2017 .

Learned A.P.P. has opposed the prayer for bail. However, he was not in a position to dispute the fact that accused on whose confession petitioner has been made accused has already been extended the privilege of bail.

Considering the fact the subsequently the accused on whose confession the petitioner was made accused has already been released on bail, there is no reason to further detain the petitioner .

Let the petitioner Anuj Patel @ Anod Patel @ Anju Patel be enlarged on bail on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge - I, Patna / concerned court in connection with N.D.P.S. (Special) Case No. 13 of 2016 [arising out of Rail Patna Junction (Rajendra Nagar) P.S. Case No. 47 of 2016]. (Rakesh Kumar, J) praful/- U T
